no, you can only write it off if you donate it to a non for proft agency type organization.

No you can’t it must be a real charity. Otherwise everyone would call it donation when it is just a gift to family.
You may not have anyhow if you don’t itemize and the charity must sell the car to determine the deduction. If they use it in the charity you don’t have a value to declare.

No.
Charity deduction is itemized deduction. You will take deduction only if your itemized deductions are more than your standard deduction.. Read: http://taxipay.blogspot.com/2008/05/itemized-deductions.html

not only can you NOT get a tax writeoff, if the car is worth more than about 10,000 (the amount may be 11,000 or 12,000) you might even have to file a gift tax return and YOU are the one paying the taxes.

You do have a lifetime gift exclusion, but you have to report gifts over a certain amount.

Figure out what you think you’d save in taxes of your brother-in-law was a 401c3 non-profit organization, and ask him to give you that money directly to BUY the car from you.

Also, when you give an auto to someone, you have to file a state gift tax exclusion form with the automobile licensing group in your state, on the car, since gifts to family members are typically not taxable at the state level. In order for your brother-in-law to register the car, he needs a sales receipt, or a gift receipt, showing the value of the gift on the form. But again, it’s not something you can writeoff.
